Two males are facing several charges following an investigation by 2 District (Niagara Falls/Niagara on the Lake) Street Crime Unit Detectives.
On Thursday January 4, 2023, Detectives observed two suspicious males in the area of Stanley Avenue and Ferry Street in the City of Niagara Falls entering a vehicle with licence plates that had been reported as stolen.
Further investigation led to the identification and arrest of the males, who were found to have stolen jewelry and a loaded 9mm Luger handgun in their possession.
21-year-old Josh Delaney and 21-year-old Donavin Stewart, both of no fixed address, are facing the following charges:

- Possession of Property Obtained by Crime under $5000 contrary to Section 355(b) of the Criminal Code
- Possession of Property Obtained by Crime over $5000 contrary to Section 355(a) of the Criminal Code (2 counts)
- Possess Prohibited Firearm Knowingly not holding a Licence contrary to Section 92(1) of the Criminal Code
- Possess Restricted Firearm without Licence contrary to Section 91(1) of the Criminal Code
- Careless Storage of a Firearm contrary to section 86(1) of the Criminal Code
- Unauthorized Possession of a Firearm in a Motor Vehicle contrary to Section 94(1) of the Criminal Code
Delaney and Stewart were held in custody for a bail hearing at the Robert S. K. Welch Courthouse in St. Catharines on January 5, 2024.
Detectives are continuing their investigation in cooperation with other police services, with more charges anticipated.
