Firearm-related offence in Welland leads to drug charges in St. Catharines

On Monday Aug. 2, 2021, at 9:12 p.m. members of the Niagara Regional Police Service (NRPS) responded to the area of Wallace Avenue and Paul Street in the city of Welland, regarding an assault in progress. 

Upon arrival, officers of 3 District Uniform Patrol determined an argument amongst friends resulted in a firearm being drawn and pointed at the victim. The firearm was not discharged. 

The accused fled the scene in a vehicle prior to police arrival.

As a result of the investigation conducted by 3 District detectives, the vehicle was located at an address in the north-end of St. Catharines. Due to the involvement of a firearm, the Emergency Task Unit (ETU), Canine (K9) and Crisis Negotiators attended to assist. On Tuesday Aug. 3, 2021 at 5:45 a.m. the accused exited the house and was arrested.

After receiving juridical authorization, 3 District detectives executed a search warrant at the north-end St. Catharines location. Detectives subsequently seized 32.4 grams of suspected cocaine, and $34,396.00 believed to be proceeds of the sale of drugs.

Javante Weston (26 years) of Niagara Falls was arrested and charged with the following offences:

  • Pointing a firearm – Contrary to section 87(1) of the Criminal Code of Canada
  • Assault with a weapon – Contrary to section 267(1)(a) of the Criminal Code of Canada.
  • Possession of a schedule I substance (cocaine) for the purpose of trafficking – Contrary to section 5(2) of the Controlled Drugs and Substances Act
  • Possession of proceeds of property obtained by crime over $5000 – Contrary to Section 355(a) of the Criminal Code of Canada

Weston was held in custody and attended a bail hearing via video link to the Robert S.K. Welch Courthouse, in St. Catharines on Aug. 3, 2021.

Madison Delaney (23 years) of St. Catharines was arrested and charged with the following offences:

  • Possession of a schedule I substance (cocaine) for the purpose of trafficking – Contrary to section 5(2) of the Controlled Drugs and Substances Act
  • Possession of proceeds of property obtained by crime over $5000 – Contrary to Section 355(a) of the Criminal Code of Canada

Delaney was released from custody on a Form 10 Undertaking and is scheduled to appear at the Welland Courthouse located at 102 East Main Street, in the city of Welland on Oct. 6, 2021.
